ROBBERY BY LAW. Sir Ellis Hume-Williams (for the defendants) said Mr. Fleming arrived in England in April, 1926, with the intention of living here permanently. He made gifts to his friends and relations, including Mr. Robinson, whom he gave £1O,OOO. In June, 1926, he had a little trouble over his income-tax. Mr. Justice Hill suggested that the income-tax of England might have been new to him. Mr. Ernest Charles, K.C. (for plaintiffs): There is income-tax in the Argentine. Sir Ellis: What a blissful country.Four days before his death, Mr. Fleming had drafted by his solicitor the will of July. At that interview he told his solicitor that his children were well provided for, each having £4O,000. In the will he made provision for the late Mrs. Elizabeth Knox Fleming during her lifetime to the extent of £50,000. Other bequests were £5,000 to his brother. Mr. F. W. Fleming, of Halifax; £lO,OOO to Marie Halstead, a niece: £2,000 to Clara Halstead, a sister; £5,000 to Marie Horniman; £5,000 to Joyce Vanderbill, a niece; £I,000 to the Royal National Lifeboat Institution, £1,000 to Dr. Barnardo's Homes, and £l,OOO to the Royal Infirmary, Halifax. He left the residue of his estate absolutely to his sister-in-law, Mrs. K. Elizabeth Knox Fleming, and directed that the will "be construed according to English law." There was a clause in the will that any legatee disputing the will or decision of the trustees forfeited his or her interests. Sir Ellis added that Air. Fleming had accumulated the fortune himself, having gone to the Argentine when a young man without a penny, and he resented the application of the Argentine law in the disposal of his estate. He often referred to it as robbery by law, which was not an insane delusion. Mr Justice Hill: Some people in this country might use the same phrase in respect of income-tax. (Laughter.)
