TUESDAY.-Before Mr. W. Barstow (chairman) and Mr. E. Bray.
Evidently A Professional.—A stranger, giving the name of George Smith, who said he was a locksmith trade, was brought up on remand from the previous Friday charged with stealing a coat, a pair of trousers, and braces, the property Aquilla Halstead, landlord of the Crispin Inn. He pleaded guilty. The Chief Constable (Mr. Pole) said that at eight o'clock on the evening the 16th instant, the prosecutor locked the things in question in an upper room at his house. Between 10 and 11 he saw the prisoner, whom he did not know, coming down stairs. Ihe door of the room just referred to was open, therefore he followed the man into the back yard. He then perceived that Smith was wearing the stolen trousers over his own garments; also that had something concealed under his coat. This proved to be the other articles mentioned. The accused was given into the custody of P.C Ashmore, who found that he had a bunch of keys hanging by a stout chain and strapped round his waist. Enquiries had been made concerning his antecedents, but without avail; he was not known at an address which he furnished to the police. He was committed to Wakefield for two months.11

Appears in a newspaper article on on 13 January 1893 at at Yorkshire, England, DRUNK OR SOBER
CHARGE AGAINST A HALIFAX LANDLORD
At the Halifax Borough Court to-day, Aquilla Halstead, landlord of the Crispin Inn, Smithy Stoke, was summoned for being drunk on his own licensed premises on the 7th inst.
The Chief Constable stated that about a quarter to nine on the morning of the date named Mrs. Halstead sent for two constables. They went to the house and found the defendant drunk. His wife was moaning as though she was in pain. There were bruises on her face and her eyes were black. The defendant gave her permission to leave the room, but when she rose he staggered towards her, and would have struck her had not the constables prevented him. Defendant was drunk. The constables got Mrs. Halstead away to the house of a relative.
Police-constable Moss gave evidence in support of the charge. He was proceeding to state what occurred between the defendant and his wife when Mr. Boocock, who was for the defence, interfered, and stated that his client was not charged with assaulting his wife. The evidence was given simply to prejudice the case.
Mr. Wavell (one of the magistrates): It is a charge which would make the defendant liable to six months' imprisonment. The evideuce is given to show the defendant's conduct.
Mr. Boocock : The statement with regard to the assault, can have nothing to do with a charge of drunkenness.
Mr. Wavell: We will judge of that.
Police-constable Moss, continuing his evidence, said the defendant attempted to strike his wife in his presence.
Mrs. Halstead (who was in court): You are telling untruths.
Mr. Boocock again objected to evidence as to an assault being given, on the ground that no such charge had been made against the defendant.
Mr. Waveli said the defendant was the holder a public licence. He was charged not only with being drunk, but with being drunk on his own licenced premises. The evidence of the constable had a bearing on the defendant's misconduct in his own house.
Police-constable Moss said he was aware that after he visited the house defendant consulted two medical men. If defendant was sober at eleven o'clock the same morning, he had probably taken something to sober him.
Mr. Boocock : What does a drunken man take to make him sober? _I don't think I am required to tell that. (Laughter.)
Corroborative evidenca was given by Police-constable Lumb and Police-sergeant Brooksbank.
Detective-inspector Farndale stated that about eleven o'clock on the morning of the 7th the defendant came to the police office, and wished to know if he had been reported for being drunk. He also stated that he should be examined by doctor.
The defendant appeared to have braced himself up for the occasion. The defendant denied that he had had anything to drink when the constables came to the house except tea. When the police left he sent for Dr. Tophain, who examined him, and he was also examined Dr. Coult- hard. Both of them told him was not drunk. A quarrel had taken place between him and his wife, and he was consequently much excited at the time.
Caroline Halstead, the wife, stated that her husband was not drunk at the time referred the police. He was greatly excited, and so was she. They had had a quarrel, as anybody else might have one. (Laughter.)
In reply to the Chief Constable, she stated that she sent for the police because she intended leaving the house until her husband cooled down.!
The Bench retired for a few minutes to consider the case. returning into court the Mayor said the Bench considered the case had been proved, and they had decided impose a penalty of £2 and costs.
Mr. Boocoek said they could not impose a fine of more than 10s. for the first offence.
The Magistrates' Clerk said that was so. He had made a mistake.
The Mayor said he was sorry they had been wrongly advised. A penalty 10s. and costs would be imposed, the highest amount they could inflict.11
In the census of 31 March 1901 at 18 Copley Street, Halifax, Yorkshire, England, Aquila was listed as aged 55 born Halifax, the Head of Household; a Plumbers Labourer, living with his wife Caroline, son Aquila S.17
