I let them to Mrs. Kennett, the wife of the defendant, who took possession on the 27th December, and occupied them up to the 28th January last. I charged her £1 a-week for board and lodging. She occupied a bed room and a sitting room. I found everything. The terms are rather lower than tboee which I usually obtain. Cross-examined: Mr. Halsted, of Fishbourne, engaged the lodgings for bis sister, Mrs. Kennett. £1 a-week I think a very moderate charge for the accommodation afforded. I made the contract with Mr, Halsted. I know that the defendant’s wife was compelled to leave on account of the ill-treatment to which be subjected her. Mr. Halsted told me that his sister was kept in a cottage not fit for a dog live in, and that ahe was not allowed the common necessaries of life. I know she left her husband on account of adultery, a charge which he had preferred against her. I took the lady on speculation. Mr. Halsted did not guarantee that I should be paid. I know that Mr. Kennett has instituted proceedings against his wife the divorce court. I knew this before I commenced this action. I know nothing with regard to the ill-treatment which she may have received at the hands of her husband, but from her own brother. Emma Frances Kennett deposed: I am the wife of William Kennett, the defendant in this action, I was married to him on the 18th June, 1848: some years ago, unhappiness sprung up between us. Differences arose about seven or eight years ago. I have not resided in his house for these twelve months past. He allotted to me a cottage to dwell in near to his own house, the cottage contained two rooms on the ground floor and one above. I went to live in the cottage which is only seven or eight yards from his bouse, from which he turned me out. I was one day talking to a young man by the name of Pennicott about 17 years old; his father is a shoemaker and has been in the habit of working for me and my husband. On the night in question Pennieott, the younger, brought a pair of boots for me, on which occasion I entered into some conversation with him at the back door of Mr. Kennett’s house. I heard some one running down the passage with the object, I thought, of frightening me. My husband came at last and found me talking with young Pennicott, and he then locked his door against me. I tried to get in, but I could not succeed, and I walked about the garden all the night alone. The next morning a message was brought to me by Mr. Kennett’s servant, to the effect that I was from henceforth to live away from him in the cottage. I lived and slept therein up to the time I took possession of the plaintiff's lodging. I had no communication with Mr. Kennett or others. When I resided at the cottage my food was cut off and sent to me from my husband’s table. I slept on the brick paved floor without a bedstead. I had a few chairs, flock mattress, four blankets, and a counterpane. The defendant was continuing her evidence, when his Honour suggested to Mr. Powell that he could not himself take any further cognisance of the case than to fully enquire whether the husband had refused maintain his wife, or whether she had on her own accord fled from the cottags which he had assigned to her. His Honour added that the plaintiff had shown a want of discretion in taking the woman into his lodgings without the husband’s approbation. Sbs would have had her remedy against him if had really driven her away. She might in such a case have contracted debts for the necessaries of life, which he would have had to liquidate. The plaintiff must look to Mr. Halsted for payment of the debt in question if he really entered into a contract to ensure his sister a residence and maintenance. It appeared to him that Mrs. Kennett had left the protection of her husband, and consequently the plaintiff must be non-suited.6 Emma Frances KENNETT and William KENNETT were divorced on 14 April 1864 at England.
