At the house of James Peace on Wednesday 16th January 1867 on view the body of David DEWHIRST deceased
Simon THORP of Thornhill Lees, Colliery Screener and Banksman, last Friday forenooon about 1/2 past 11 o'clock I was hanging on at Thornhill Combs Colliery belonging to Capt J C INGHAM and saw deceased under the screens and the first wheel of a full wagon go over his left leg just below the knee. Geo. LEDGARD was on the contrary side of the wagon and was letting the wagon loose to go down the inclined railway. Deceased ought to have been below the two lines of railway. He had nothing to do with the wagon which was being moved. I heard LEDGARD call out "Look out" before he took the scotch from under the wheel. I was passing behind some wagons to my work and did not see deceased until he was being run over. i did not hear him cry out. i picked him up. He said "Oh Simon take hold of my leg" John LAWSON was close by on the other line and was ?zing and wagon (empty) out from under the screens. I handed deceased to LEDGARD and went for the doctor. The full wagon had gone about 4 yards from undet the screens and stopped when it had gone over deceased.
Thomas NOBLE of Thornhill Edge End a Coal Leader says. I was at Combs Pit last Friday morning and saw deceased at the side of a wagon which was standing still. i passed deceased and went up the steps to the and directly afterwards i saw he was injured the men at the bottom were attending to thier work. i had a whip in my hand as I went up the steps.
George LEDGARD of Brierfield, Colliery Screen Man says. Deceased was picking scales of a wagon last Friday morning about 1/2 past 11 o'clock - John LAWSON had to do with that wagon. I went down to move another wagon on the second line of rails. I todl the three lads who were in my wagon to get off and they did so I went on to a small platform on they throw their scales. I knocked the scrotch away from the front wheel and went round the wagon to the break. I did not then see deceased. I saw Thomas NOBLE at the bottom of the screen when I went down. I pushed the wagon at start it and after going about 3 yards I heard Simon THORP say "Put the break down and stop the wagon" I did so and on going to the front of the wagon I found Simon with deceased in his arms. I carried deceaed home. he had been 4 or 5 months at the work.
Eliza the wife of Janes DEWHIRST of Partridge Row, Thornhill a Colliery engine worker says. Deceased was 10 years old and a scale picker at a colliery and my son.He was strong and active for his age. He was brought home at noon last Friday. He said he was going to have his dinner warmed and saw the lash of a whip which Thomas NOBLE was cracking as he went up stairs and as he steps back he was run over. His leg was crushed below the knee. Mr HADFIELD attended him regularly afterwards. Deceased said that he did not notice the wagon and that NOBLE did not see him. He died last Sunday night at 20 minutes to 10 o'clock.
Verdict Accidently run over.5
