Cooper, a painter, was brought upcharged with committing a criminal assault upon the person of Ann Walker, aged 15, a nurse, in the service of Mr. John Brooks, draper. The prisoner, who married and has family, was sent by his masters to do some work in Mr. Brooks's house, which would take two or three days to complete. On Wednesday morning, about six o'clock, he rung the bell, and was admitted by prosecutrix, who at once requested him to finish his work in her bed-room first ; to which he said he would plaster it first thing, andthen go to another part of the house till it dried. He then went upstairs. About ten o'clock, the same morning, prosecutrix went to her bedroom for the purpose of scouring the floor, as directed her mistress. Upon entering the room, prisoner who was about finishing his work there, seized her by the hair of the head, and dragged her to the floor ; upon her attempting to scream, he got hold of her by the throat, and kept her in that position until he had effected his purpose. After a lapse of between five and ten minutes, Mrs. Howarth, who was in attendance upon Mrs. Brooks, as nurse, came into the room, and saw prisoner and prosecutrix on the floor. Prisoner was asked twice to leave the room, but he refused, and did not go until Mrs. Howarth said she would call Mr. Brooks. Elizabeth Howarth confirmed the latter part of the girl's statement, and George Smirthwaite, surgeon, gave medical evidence. Prisoner denied the charge, but reserved his defence. He was committed to take his trial at the Liverpool Assizes.4

SALE TO COMMENCE SATURDAY, DECEMBER 2nd, I865. Opposite the Boot Inn, Burnley.4

Appears in a newspaper article on on 16 December 1865 at at Liverpool, Lancashire, England, RAPE. Thomas Cooper, 28 years of age, was charged with having at Burnley, on the 13th of September, committed a rape upon Ann Walker. Mr. Kaye prosecuted, and Mr. Pope defended. The prosecutrix, a girl of about 16 years of age, was employed by Mr. Brooks, at Upholland, as nurse, and the prisoner, who is a painter, had been employed in the upper rooms of Mr. Brook's premises where the offence was committed. The jury found the prisoner guilty, but recommended him to mercy on account of his previous good character. His lordship, in passing sentence, remarked that he could not give effect to the recommendation of the jury, inasmuch as this was a case of a nature which called upon him as a guardian of society, and particularly of the weaker portion of society, to pass severe sentence, which was that he be kept penal servitude for seven years. The prisoner fainted on hearing the sentence, and was removed from the dock in an insensible state.4
