Adolph William Albert GRUNOW

This was on interpleader matter, which, was submitted by consent to his Honor's decision.

The plaintiff, a wholesale butcher, had obtained a judgment on August 7, and issued execution against the defendant, a retail butcher. Halstead, the defendant's fathor-in-law, claimed his stock-in-trade under an absolute bill of sale, dated 28th April, which was duly registered on the 25th May. And the claimant set out that the bill of sale was given bona fide for actual advances made, part of which went to reduce the defendant's indebtedness to the plaintiff. The judgment debtor had never parted with the possession of the goods.

Mr. Field, instructed by Mr. C. B. Pitt, for the claimant, cited the Credit Co. v. Pott (L. R., G Q. B., 695) to show that the statement of consideration was sufficient.

Mr. Gibson, instructed by Mr. Lucas, for the judgment creditor, contended that this being an absolute bill of sale was bad as against tho judgment creditor. There must be a bona fide change of possession. Edwards v. Harben (2 T. R., 587), and other cases cited under Twyne's case in Smith's Loading Casos (8th edition), vol. 1, p. Î3 ; Wardell T. Smith (1 Campb., 333).

Mr. Field replied. To say that the bill of sale was void as being a fraud against 'creditors under 13 Elizabeth, would be to make all absolute bills of sale void. The case of Edwards v. Harben was mentioned unfavourably in Benjamin on Sales, 2nd edition, p, 406.

The judgment debtor and the claimant were then ex- amined orally, and swore that the advances were made bona fide.

His HONOR held that it was not such a bona fide trans- action as the law would uphold. Ho could not get over the dictum of Lord Ellenborough in Wardill v. Smith, that in tho case of an absolute bill of sale the grantor must part with tho possession of the goods.1
Adolph died in 1921 at St Leonard, New South Wales, Australia.2
