An uncommon compensation case was heard at the Huddersfield County Court yesterday. Annie Boothroyd and her six children claimed compensation in respect to the death of her husband. Frank Boothroyd, horsekeeper. employed by the Leeds Fireclay Company (Limited). Huddersfield. Mr. F. Sykes, for the applicants, explained that on July 15th. which was an exceptionally hot day, Boothroyd was taken from his ordinary occupation to make hay and whilst in the field he had a sunstroke and died almost immediately. Evidence was given by two doctors that there was much more risk of sunstroke in the ease of a haymaker than the case of a horsekeeper.
Mr. Smith (Bradford), for the respondents, argued that there was no special risk attached to the work to which the man was sent. If there were judgment for the applicant thousands of outdoor labourers would be brought under the Compensation Act.
His Honour deferred judgment.5
