Evidence was given by petitioner that the parties lived together happily at Huntly until they took in a boarder. Petitioner noticed an undue familiarity between his wife and the boarder and when he came home onoe day he found his wife had gone. She left a note stating that she had gone away with the boarder. There was one child of tho marriage and this child lived with petitioner. A decree nisi was granted.6

To his mates, William Horn Henderson was a hero. What he is to, Joe Stanworth, whose wife he stole, the wronged husband can best tell.
Both the hero and the husband were miners at Huntly. The hero, who wears a medal for bravery in the mine, is now living in Wellington with his mate's wife.
JOE STANWORTH is a Lancashire lad and his wife was a Lancashire lass. They were, married at St. Peter's, Burnley, after the war in 1919, and came out to New Zealand shortly afterwards. They went to reside at Huntly, where they were happy with their one little boy until the year 1928, when they took in a lodger in the person of William Horn Henderson, who wore better clothes and was better educated than the hard working husband.
It was not long before there was trouble. Stanworth began to notice a gowing fondness between the boarder and his wife with a correspondingly growing frigidity towards himself.
This condition of things was not lost upon the residents of Huntly who were familiar with the parties, and it became a matter for comment among some of Stanworth's confreres in the mine that somehow it had come about that the shifts which the two men worked had been so altered that Stanworth tolled when Henderson was at home.
When Stanworth returned home tired after his day's work on September 5 last, he found that his wife and Henderson had decamped. On the table a note awaited him from his Wile. In this she stated: —
"You have only yourself to blame for this. I am off to a job down south, as I am sick of being told I am too much trouble, so you can get the other woman now. Freddy is down at Ciss's. Horn has paid me and I think I am entitled to it for once.
A short time before the elopement, there had been an accident in the mine at Huntly, in which Henderson, and two other miners named Broadbent and O'Brien were injured. Henderson, on that occasion, assisted his two comrades to safety, and was, presented with a medal for what he had done.
It was while he was convalescing that he and Mrs. Stanworth eloped.
Shortly afterwards he was presented with papers citing him as corespondent in the action which Stanworth brought for a divorce.
The case was heard at the Hamilton Supreme Court last week, and originally a substantial sum was claimed for damages against Henderson.
He offered, ' however, to square, the claim against him for £50 and a promissory note for this amount was accepted.
Stanworth told Mr. Justice Herdman that the home was quite happy until they took in Henderson as a boarder. He then began to notice signs of familiarity between his wife and Henderson. which culminated, as stated, in the two running away together. They were, he said, now living as Mr. and Mrs. Henderson at Wellington.
He had not heard from his wife since she left.
Although the woman deserted her child when she cleared out with the boarder, she apparently still cherished some slight mother feeling towards him when she wrote him the following letter: —
"Dear Freddy,— l have got no letter from you yet. Aren't you going to write to me? I want to know how you are getting on. It is lovely down. here. Are you going to come down for your holidays? Are you having any fireworks next month? I wish I could send you some, but I cannot send them through the post, but I will send you some more meccano soon. "How did you like the others? Would you like some weighing machinery and some seats for your station and some tiny luggage? Let me know which, Freddy, and write to me soon. Best love from mother." Then follows a string of crosses.
His Honor asked Stanworth what his wife's reference - in the note she left behind - to the other woman meant.
The reply was that he did not know.
His Honor: Had you had any previous trouble with her? — No.
The judge said adultery had not been proved, but Mr. W. Clavis, who represented petitioner, contended that the letter which the woman sent her son, and which was headed "Mrs. Henderson." followed by her address in Wellington, was sufficient corroboration.
If not, surely the admission of Henderson in his affidavit, and the fact that he had paid m a certain sum as costs and damages, was sufficiently corroborative. ?
His Honor was still not satisfied, and Mr. Clavis then produced the affidavit of service in which the Lawyer's clerk in Wellington said the woman had frankly admitted to him that she was living with Henderson as his wife.
Satisfied, his Honor granted a decree nisi.
Mr. Clavis asked for an order that the £50 damages be paid out.
M. N. Johnson, representing the wife, said this was in the form of a promissory note and might be of no value. In any case, costs had to be taken out of it, and there probably would not be much of it left.
His Honor ordered the note to be handed to the registrar.7
