Physicist Fined Because a man was said to have been spying on nudists at a sunbathing centre at Liphook, an alleged assault was committed which was the subject of a Police Court case at Petersfield to-day. Capt. Evelyn Jollife Halstead Hanby, Weaversdown House, Liphook, whose residence had recently been converted into a centre where nudism could be practised, was charged with assaulting Frederick Charles Stone, butcher’s assistant, Wendham Bungalow, Griggs Green, Liphook.
Hanby who first pleaded not guilty and later altered it to “guilty” of a technical offence was fined £l. He was represented by Mr. J. Sterling (instructed by Frank Hill and Nightingale, London) and Mr. J. M. Furneux represented complainant.
Stone said that on May 17 he was taking a short cut to his uncle’s house the other side of Weavesdown. He sat down on the branch of a tree. The park was a public highway. Hanby’s gardener came out of the grounds and asked him what he was doing there. "That is no business of yours,” witness replied.
Then Gardener was heard calling for "The boss" and defendant came out.
Knocked Into Bushes
“Hanby said to me * I won’t have you peering about here. Clear out. You are a dirty filthy scum.’ I told him I was not interfering with him. He charged into me and knocked me over into some bushes,” said complainant.
In cross-examination, Mr. Sterling suggested that there was animosity on Stone’s part because his uncle had been evicted from his cottage which was in Hanby’s grounds. A series of incidents of molestation and irritation to Capt. Hanby and the sunbathers had occurred, added Mr. Sterling.
Witness denied peering through the hedge or climbing the tree to see what was going on. He was not up 30ft. in the tree, but was only sitting on a low branch. He knew that sunbathing and nudism were practised there, and that they had been subjected to annoyances. He had suffered no physical damage from the alleged assault.
Miss Noel Stephanie Vaughan Williams of Sweet Briar Farm. Weaversdown, said that from her garden she saw the defendant push Stone over a gorse bush. "I heard a noise first—the noise of screaming abuse, hulabalooing and an awful scrimmage. People rushed from all directions.” she added. It was not necessary for complainant to climb the tree as there were several other points of view into the garden. The cause of the annoyance was because complainants uncle had been evicted.
Garden Damage
Captain Hanby said that before giving notice to quit to complainant's uncle he had had no trouble. The molestations stopped after the summons was issued. Some of the incidents that happened were the pulling up of a number of newly planted raspberry canes, which only complainant and his uncle knew were there, pulling up plants and trampling down of vegetable beds, the smashing down of a fence, and the throwing of a shower of stones, some of which nearly hit his wife and child. The hedge was set alight, and 15 feet away was his child sleeping out in tent. On one occasion he caught the complainant “Scuttling away” from his grounds, and said, I did not do anything" before he (witness) had said a word to him.
He and his wife were physicists, he explained. His wife owed her life to the cult of nudism and sunbathing. On May 17 when the assault was alleged to have taken place, he saw- Stone high up in a tree overlooking his grounds. He pulled Stone down by the sleeves and pushed him. Witness admitted losing his temper. Stone fell over some bracken, he said.2
