For driving a motor lorry in Whalley Road, last month without due care and attention. John Halstead Ormerod (48), farmer, of Moor Fell Farm, Hurstwood, was fined 60s. and ordered to pay £2 Os. Id. costs at Padiham on Monday.
The summons was the sequel to an accident in which Ormerod's vehicle collided with another lorry
James Summer, motor driver, of 12, Palmerston-street Padiham, said he was driving his lorry along Whalley Road in the direction of Padiham and had reached the left-hand bend near the top of Dean Hill when he saw two wagons approaching from the opposite direction. Witness said he had just turned the bend when he saw defendant's lorry 15 to 20 yards away on the offside of the roadway, apparently trying to overtake one of the other vehicles.
In an endeavour to avoid a collision, witness said he applied his brakes and ran on to the footpath, but despite this defendant's vehicle hit the side of his lorry.
APPLIED BRAKES
Mr T D Rice, of Manchester, for the defendent said that Ormerod, when attempting to overtake the other vehicle, had seen the lorry coming in the opposite direction.
There was plenty of room at the point where the accident occured for three vehicles to be driven abreast, and defendent's error had been to apply his brakes, because that was the skid which had caused the accident.7
