This agreement, however, was never signed, and co-habitation was resumed almost immediately afterwards. The cruelty commenced again, and in May, 1910, the petitioner took out a summons in the Burnley Police Court for persistent cruelty against the husband. The husband implored the petitioner to withdraw the summons, and she did so and again returned to her husband, who signed another agreement to treat her properly. In December, 1911, he again began to ill-treat her, and an act of violence took place at the Burnley Railway Station. At a later date, said counsel, the respondent cohabited with a woman named Minnie Brown.
Petitioner, giving evidence, said her husband's ill-treatment continued from October, 1907, until she commenced the proceedings in the present action.4
Amelia died on 7 September 1974 at Durban, South Africa, at the age of 88.
