Charles Halstead, landlord of the Elephant and Castle Inn, Holmfirth, waa charged with keeping hia house open during prohibited hours on Sunday the 24th April. Mr. R. Meller defended. Police constable Ingham said about seven minutes past five o'olook he was at Upper- bridge, Holmfirth, and heard a noise at the Elephant and Castle Inn, and found eight men in and glasses on the table containing beer and wine. Seven of the men were strangers and said they came from Lockwood. John Edward Pearson was also in and drank a glass of wine off. In the bar he found Wm. Comery lying on the seat. Ha called the landlord's attention and he said he was not aware. Pearson followed him out and said he had only been playing the "Dead March" for Lord Beaoonsfield and asked for the oase not to be reported as it would do him an injury. Cross-examined by Mr, Meller: Comery was in the bar but had nothing before him, he did not speak to him. No one except the landlord and he were in the bar. He did not speak to Mrs. Halstead. Three women came up the passage and he believed Mrs. Comery was one of them. The front door was open when he went in. Pearson did not say he had oome for his wife. Mr. Meller for the defence said Mrs. Halstead had been to Mr. Comery's to dinner and arranged that Mr. and Mrs. Comery should come to tea at her house. Mrs. Halstead and Mrs. Comery want for a walk and returned about five o'clock. Pearson was in the house unknown to the landlord and he supplied him with nothing, and if he did drink claret it was unknown to Halstead. Comery was their as an invited guest. The front door was not fastened and everything was done openly and without fear. Oharles Halstead said on the day in question a party of visitors from Lockwood way oome to the house about four o'olock. He decided they were bona fide travellers. The horse was put up in the stable and the waggonetts in the yard. They came in by the front door. He did not know Pearson was in the house until the officer came to the bar door and brought Pearson with him. Witness told Pearson he had no right there and he replied he had come simply to see if his wife had come back. He did not supply any drink to Comery after 2 30,nor had he any glass before him when the officer came in, neither did he mix with the other company. Witness's wife had been for a walk that afternoon with Mrs. Comery and Mrs. Pearson. By Mr. Goodall: He supplied drinks to the Lockwood party about 20 minutes before the officer oame in. Pearson was not in then. Mrs. Halstead proved that she dined with Mr. and Mrs. Comery and then invited them to tea and generally corroborated her husband's evidence. Wm. Comery also corroborated the evidence of the landlord. Witness did not know that Pearson was in the house. Mrs. Halstead had been to church in the morning and on her return porridge had been prepared for her return and as she aid not like them she went to diner at their house. By Mr. Goodall : Whilst in the bar he was smoking and reading, but was not asleep. Mrs. Comery said that at dinner time she was invited along with her husband to tea by Mrs. Halstead. John Edward Pearson and Wm. Comery were then charged with being on licensed premises during prohibited hours. Inspector Shepley said Pearson came to the office along with Police-constable Ingham and stated that he had been in search of his wife and found several friends from Lockwood and he was treated to a glass of olaret so he played the " Dead Maroh" in Saul for them. He declined to say who supplied him with the olaret or to say anything further. Halstead said he did not know Pearson was in. He supplied wines, bottled beer, &c., but nothing to Pearson. The Benoh retired and after a consultation decided to dismiss the case against Comery and against Halstead as there was not sufficient evidence to show that he knew Pearson was in, but fined Pearson 5s. and costs.⁷

The Chairman said that the Government would deal with the question next session. Mr. Armitage then required proof of notices, which was given, and then urged that ratal of £12 10s. was not sufficient to entitle him to a licence. The Bench granted all the applications.⁴
