Both Dismissed in the Divorce Court
Reginald Halstead, cinema manager, of Southport, petitioned in the Divorce Court yesterday for the dissolution of his marriage with Mrs Louisa of Stamford Place, Leeds. Mrs. Halstead crosspetitioned for judicial separation on the ground of cruelty. Mr. and Mrs. Halstead were married in November, 1920. Mr. Halstead's case was that in April. 1931, he left his wife the flat at Lord Street with the co-respondent, Kenneth Gibson, and that they then committed adultery, Both Mrs, Halstead aud Gibson denied the adultery alleged. Mr. Haistead denied the cruelty alleged against him. Mr. Justice Bateson, summing up, said the proof offered by the husband was that he saw his wife and the co-respondent in the act. The wife said her husband's story was a mistake. She said that she was struggling with the co-respondent, Gibson. when her husband saw her. It was not disputed that the co-respondent was trying to kiss her. The assertion was that it was a drunken attempt and that nothing came of it. The jury found that Mrs. Halstead and the co-respondent, Gibson, had not committed adultery. Mr. Justice Bateson dismissed the husband's petition with costs, and refused the wife's petition for Judicial separation.6

JUDGE & "CRUELTY.” A PETITION by Reginald Halstead, described as resident manager the Palladium picture house in Lord-street, Southport, for the dissolution bis marriage with Louisa Halstead, who gave an address at Stamford-place, Leeds, was heard by Mr. Justice Bateson and a common jury in the Divorce Court, London, to-day.
The petitioner alleged that his wife had committed adultery with Kenneth Gibson, who was described the son of a wholesale pottery dealer, in Southport. Both the respondent and the co-respondent denied the adultery alleged, and Mrs. Halstead asked for judicial separation, alleging cruelty Mr. Halstead denied the cruelty alleged.
Mr. and Mrs. Halstead were married 1920. Mr. Justice Bateson, summing up to the jury, said the question of cruelty was for him to decide if it arose. Its only relevance to the questions the jury had to decide was to help them to determine who was telling the truth. He would only say that husband and wife had, with one exception, been on perfectly good terms until the final separation, and they had apparently been on good terms since. The so-called cruel husband had been asked to take charge of the children.
The husband, Mr, Justice Bateson went on, had to prove his case to succeed in his petition for divorce. The proof he offered was the statement that on the night of April 13th, 1931, he found his wife and the co-respondent together committing misconduct. The jury could not get much better proof if they believed it.
The wife said that the husband's story was a mistake. She said she was struggling with the co-respondent when her husband saw her.
It was agreed that the co-respondent, Gibson, and Mrs. Halstead were in the bedroom. There was no dispute that the co-respondent, Gibson, was trying to kiss Mrs. Halstead. At the very best it was a gross outrage on this lady in her own house. The assertion was that it was a druken attempt by the co-respondent, Gibson, which came to nothing.
