It appeared from the evidence of the bank ranger of the company that the wheelbarrow had on it the brand the company, L.L.C.C., but the sides were not such as the company put on. He could only say it was the company's property from the brand. The company never made barrows for any but themselves, and had never known them sell any. The prisoner had been to him and told him he had found the barrow in the river Brunn behind the Well Hall publichouse and said he wanted 2s. 6d. for finding it, or he would sell it. He did sell it to James Dean, marine store dealer, for 2s. 8d., the bank ranger refusing to give him 2s. 6d. for it unless had authority to do so. The prisoner said he had a witness in the Court who saw him get the barrow out of the river. He was not called, however, the Bench thinking the evidence not sufficient to convict the prisoner.
